At BAJOPHONE, we pride ourselves on offering high-quality digital products and resources. Due to the nature of our business model, our return and refund policies are strict and differ from traditional e-commerce stores.
By making a purchase on our Website, you expressly agree to the terms described in this Refund and Returns Policy.
1. DIGITAL NATURE AND FINAL SALES
1.1. 100% Intangible Products: All products marketed on BAJOPHONE are strictly digital and intangible files, accesses, and goods. We do not sell, ship, or distribute any type of physical, electronic, or tangible product.
1.2. Finality of Sale: Due to the immediate and easily duplicable nature of digital products, all sales made on BAJOPHONE are final. Once payment has been processed and the file or access link has been delivered (via email or direct on-screen download), the product is considered "opened" and "used".
1.3. Impossibility of Physical Return: As no physical item is shipped, it is materially and logistically impossible to "return" the product to our facilities. Therefore, no merchandise return requests will be processed under any circumstances.
2. WAIVER OF THE RIGHT OF WITHDRAWAL (DIGITAL GOODS LEGISLATION)
2.1. Legal Exception: In accordance with consumer protection legislation (including the European Consumer Rights Directive and analogous legislation in Spain and Latin America), the standard right of withdrawal or cancellation (usually 14 days) is not applicable to contracts for the supply of digital content not provided on a tangible medium.
2.2. Loss of Right: The Customer expressly acknowledges and agrees that, by initiating the download of the digital file or by receiving the email with access to the product after payment confirmation, they irrevocably lose their right of withdrawal or cancellation of the purchase. The consumer's prior and express consent to this condition is an indispensable requirement to finalize the purchase in our store.
3. REFUSAL OF REFUNDS FOR "FORMAT CONFUSION"
3.1. Store Transparency: BAJOPHONE clearly, visibly, and unequivocally states in its Terms and Conditions, as well as in its product descriptions, that NO physical electronic devices (such as mobile phones, smartphones, hardware, etc.) are sold. The trade name "BAJOPHONE" does not imply the sale of physical phones.
3.2. Refund Denial: Any refund, cancellation, or payment dispute (chargeback) request based on the Customer's mistaken belief of having purchased a physical or tangible product will be automatically rejected and denied. It is the sole responsibility of the Customer to read the product description and legal notices before completing the transaction. BAJOPHONE will use this document, along with the records of acceptance of the Terms and Conditions in the payment process, as irrefutable proof before payment gateways and banking entities in case of unjustified disputes.
4. EXCEPTIONS AND TECHNICAL ASSISTANCE
Despite our strict "no refunds" policy, at BAJOPHONE we are committed to quality. We will only consider issuing a refund or replacement in the following exceptional scenario:

Defective or Corrupt File: If the delivered digital file is technically damaged, illegible, or has an original defect that completely prevents its viewing or use, and our technical support team is unable to provide you with a functional replacement file within a reasonable timeframe.

Condition: To qualify for this exception, the Customer must notify customer service of the technical problem within a maximum of 48 hours from the date and time of purchase, attaching screenshots of the error and proof of the defect.
5. COMPLAINTS AND BANKING DISPUTES (CHARGEBACKS)
Any attempt at fraud, such as filing a dispute or chargeback claim with PayPal, Stripe, or your bank falsely alleging "product not received" or "product different from described" after having downloaded the digital file, will be considered a violation of our Terms and Conditions.
BAJOPHONE has systems for tracking IP addresses, email sending records, and download timestamps. All this information will be immediately sent to the relevant financial institutions, fraud prevention departments, and may result in the Customer's suspension from future purchases and possible legal action.
